If you are under the age of 18, you represent that you have the consent of a parent or legal guardian to use the Services.

2. Accounts and Registration

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Yours Truly is not responsible for unauthorized access resulting from your failure to safeguard your credentials.

You may request deletion of your account at any time. Upon verified request, we will delete your account and associated data in accordance with our Privacy Policy and applicable law.

3. User Content and Responsibility

The Services allow you to upload, store, create, and manage content, including text, images, audio, video, memories, messages, and other personal or sensitive information ("User Content").

You retain ownership of your User Content. By submitting User Content, you grant Yours Truly a limited, non-exclusive, royalty-free license to host, process, store, reproduce, and display such content solely for the purpose of providing and improving the Services.

You are solely responsible for:

  • The accuracy, legality, and appropriateness of your User Content
  • Ensuring you have the right to upload or share such content
  • Any consequences arising from the sharing or use of your User Content

Yours Truly reserves the right, but has no obligation, to review, remove, restrict, or disable access to User Content that violates these Terms, applicable laws, or our policies.

4. Sensitive Information and Data Retention

You acknowledge that you may choose to share highly personal or sensitive information through the Services. We will retain such information until you request deletion, subject to legal or operational retention requirements. While we implement reasonable security measures, you understand that no system is completely secure, and you provide sensitive information at your own risk.

5. AI and Automated Processing Disclaimer

Certain features of the Services use artificial intelligence or automated systems to analyze, summarize, generate, or personalize content.

You acknowledge and agree that:

AI outputs may be inaccurate, incomplete, or subjective

  • The Services do not provide legal, medical, psychological, or professional advice You are solely responsible for how you interpret or rely on AI-generated content.

6. Digital Legacy and Posthumous Features

The Services may allow you to create messages, memories, or instructions intended to be shared after death or incapacity.

You acknowledge that Yours Truly:

  • Is not a law firm, estate planner, trustee, executor, or fiduciary
  • Does not verify death, incapacity, or legal authority
  • Does not guarantee delivery timing or outcomes

You are responsible for ensuring that your use of these features aligns with your estate plans and applicable laws.

7. Subscriptions, Free Plans, and Payments

Subscriptions and Freemium Access

Yours Truly offers a free version of the Services with limited features and paid subscription plans with enhanced functionality. Subscription details, pricing, and features are disclosed at the time of purchase.

Payments

All payments are processed by Stripe, a third-party payment processor. Yours Truly does not store or process credit card information. Your payment information is subject to Stripe’s terms and privacy practices.

Refunds

Refunds may be granted at our discretion in cases of:

  • Accidental purchase
  • Verified medical conditions

Refund requests must be submitted to legal@yourstruly.love within a reasonable time of purchase. Approved refunds will be issued to the original payment method.

8. Cookies and GDPR Compliance

We use cookies and similar technologies as described in our Privacy Policy. A cookie consent tool is provided to manage your preferences.

12. Limitation of Liability

To the fullest extent permitted by law, Yours Truly shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including emotional distress, loss of data, or loss of profits.

Our total liability for any claim arising out of or relating to the Services shall not exceed the amount you paid to Yours Truly in the 12 months preceding the claim, or $100 if no payment was made.

13. Indemnification

You agree to indemnify and hold harmless Yours Truly and its officers, directors, employees, and affiliates from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.

15. Dispute Resolution and Arbitration

Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration, conducted on an individual basis. You waive the right to participate in class actions or jury trials. Arbitration shall take place in Delaware unless otherwise required by law.

16. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on the Services and become effective upon posting. Continued use of the Services constitutes acceptance of the revised Terms.
